Customer agrees that typing their full name below, or drawing their signature, constitutes an electronic signature with the same legal effect as a handwritten one, and that this document may be signed and exchanged electronically.

Optional — Agave may photograph the finished setup for marketing. Equipment and table settings only; never guests, children, or the event itself. Declining changes nothing about this booking.

Terms & Conditions

This agreement is between Agave Events LLC (doing business as Agave Events Co.), “Agave,” and the Customer named on page 1. Equipment remains the property of Agave Events LLC at all times.

Special terms. Any concession recorded in the “Special terms for this booking” box on page 1 — a discounted rate, a waived delivery fee, or a waived deposit — overrides the corresponding standard term below, for this booking only. It is a one-time courtesy and does not change Agave’s published rates or entitle Customer to the same terms on any future booking.

1. Booking & payment

$75 order minimum, before the delivery fee.
A 25% deposit is due at booking. The date is not held until the deposit clears.
The balance is due on delivery, before setup begins.
Accepted: cash, Zelle, or card. Card payments carry a 3% processing fee.
Prices are per day. Each additional day is 50% of the item rate.

2. Delivery, setup & pickup

Delivery is flat by zone — $79 within 10 miles, $119 within 20 miles, custom beyond. No per-item setup fees and no fuel surcharge.
Arrival times are 2-hour windows, not exact times.
Someone 18 or older must be present at delivery to walk the count and sign.
Customer guarantees clear, safe, ground-level access — an unobstructed path, no locked gate, no unrestrained dogs, and no stairs beyond one short flight unless disclosed at booking.
Equipment stays where it is set up. It may not be relocated to another address.
At pickup, items must be stacked and consolidated at the original setup point, dry and emptied. Items not stacked incur a $25 handling fee.

3. Care & use

Chairs are for seated use by one adult each. No standing on chairs or tables.
No writing on, taping to, drilling, stapling, or cutting any item.
Keep tables and chairs out of pools, mud, and standing water.
Linens: shake out food and debris and return them dry and loose in the bag provided. Do not wash them — Agave launders. Never leave a wet linen bagged; it mildews.
Canopies must remain staked or weighted at all times. Do not add sidewalls, lighting, or signage without approval.

4. Weather

Wind is the primary risk, not rain. Agave may decline to erect canopies, or may take them down, when sustained wind exceeds roughly 20 mph or a dust storm or microburst warning is active. The safety call is Agave’s and is final.
If wind picks up after setup and Agave cannot reach the site in time, Customer is responsible for taking canopies down or weighting them further.
Weather cancellations: 72+ hours out, the deposit is refunded in full. Inside 72 hours, the deposit converts to a credit valid 6 months — the date has already been turned away.

5. Cancellation & changes

Reductions to an order inside 72 hours are billed at the original amount.
Additions are welcome any time, subject to availability.
Agave may cancel and refund in full if conditions are genuinely unsafe — site, weather, or vehicle. That is the only refund overriding the table above.

6. Damage, loss & replacement schedule

Normal wear is expected and is never charged. Items damaged beyond repair, or not returned, are billed at these published rates, set at replacement cost plus handling and lost rental time:

Cleaning fees, charged only when soiling is past normal: linen stained beyond laundering $25 each; gear returned with paint, tape residue, gum, wax, or caked food $25–$50 depending on the item; items returned wet and bagged $25.

Late return: equipment not available at the agreed pickup window is charged one additional full day per day held.

7. Liability

Customer is responsible for the equipment from delivery until pickup, and for its safe use by every guest.
Agave is not liable for injury or property damage arising from Customer’s or guests’ use, misuse, or placement of the equipment after setup is complete.
Customer agrees to hold Agave Events LLC harmless from claims arising out of the event, except for Agave’s own gross negligence.
Agave’s total liability is capped at the amount paid for the rental.
Equipment may not be sublet, loaned, or moved off-site.

8. Governing law

This agreement is governed by the laws of the State of Arizona, Maricopa County. If any provision is found unenforceable, the remainder stays in force. This document is the entire agreement between the parties and supersedes prior discussions.
